In the last episode of our series on studying the Bible, we transitioned to an important area of study: learning to read the Bible in terms of the various types of literature found in its pages. Our first example concerned reading narrative, where I recommended reading biblical stories like fiction -- like you would read a novel. In this episode we focus on the legal genre of the Bible using a controversial example from Exodus 21.

In Episode 23 of the Naked Bible Podcast, Dr. Michael Heiser continues his series on how understanding genre enhances biblical interpretation—this time by exploring the legal genre in Scripture. Using the controversial case in Exodus 21:22–23, where two men fighting accidentally strike a pregnant woman, Heiser dissects how modern political debates—especially around abortion—often distort the passage’s purpose and context. Drawing on ancient Near Eastern legal parallels like the Code of Hammurabi, Heiser shows that the different penalties assigned in the passage are based on social class, not theological statements about personhood or the value of a fetus. This genre-specific insight dismantles common misreadings and illustrates how biblical law functioned much like applied precedent in ANE societies. Heiser warns against importing modern philosophical questions into ancient legal texts, and instead encourages genre-sensitive exegesis as the key to faithful and informed interpretation. A vital episode for anyone serious about hermeneutics and the ethical use of Scripture.
